Return, Refund, and Claims Policy

All Sales Are Final
New York Cosmetics is a wholesale supplier of cosmetics, beauty products, personal care products, closeouts, overstock, discontinued merchandise, shelf pulls, and other opportunistic inventory.
All products are sold “as is,” and all sales are final. We do not accept returns, exchanges, cancellations, refunds, or store-credit requests because a customer:
• Changes their mind
• Orders the wrong product, shade, quantity, or case pack
• Purchases more inventory than they can resell
• Is unable to resell the merchandise
• No longer needs or wants the merchandise
• Finds the merchandise available elsewhere at a different price
• Disagrees with the listed MSRP or resale value
• Experiences a change in customer demand or market conditions
• Is dissatisfied with ordinary packaging wear that was disclosed or is consistent with the merchandise condition
• Fails to review the product description, quantity, case-pack requirement, condition, size, shade, expiration information, or other listing details before ordering
Limited exceptions may be made for approved claims involving an error by New York Cosmetics, qualifying damage or defects present upon delivery, missing merchandise, or an incorrect product received.
This policy applies to the fullest extent permitted by applicable law and does not limit any rights that cannot legally be waived.
Wholesale and Closeout Merchandise
Our inventory may include closeout, liquidation, shelf-pull, discontinued, overstock, promotional, and other wholesale merchandise.
Depending on the product and its listing, merchandise may have:
• Stickers or retail labels
• Minor dents, scuffs, scratches, or shelf wear on exterior packaging
• Packaging from a prior season or promotion
• Variations in outer packaging
• Discontinued or older packaging designs
• Manufacturer packaging changes
• No outer retail box when listed as loose
• Short-dated or dated merchandise when the applicable date is disclosed
• Other cosmetic packaging imperfections that do not materially affect the product
These characteristics are not considered defects when they are disclosed in the listing or are reasonably consistent with the stated condition of the merchandise.
The product title, photographs, condition designation, quantity, case pack, size, shade, UPC, expiration information, and written description should be reviewed before placing an order.
Inspecting Your Delivery
Customers must inspect all deliveries immediately upon receipt.
Before signing a carrier’s delivery receipt, bill of lading, or proof of delivery, the customer should:
Confirm the number of pallets, cartons, and cases received.
Inspect the shipment for visible crushing, punctures, water damage, tampering, missing cartons, broken wrapping, or other damage.
Note all visible damage or shortages on the carrier’s delivery record.
Take clear photographs of the shipment before it is unpacked.
Keep the original cartons, pallet wrap, labels, packing materials, and damaged merchandise.
Signing for a visibly damaged shipment without noting the damage may limit our ability to recover from the carrier and may affect claim eligibility.
Concealed damage, shortages, fulfillment errors, and other issues must still be reported within the claim period below.
Claim Notification Deadline
Any problem with an order must be reported to New York Cosmetics within five business days after delivery.
Claims received after five business days may be denied because we may no longer be able to verify inventory, investigate the shipment, or file a timely claim with the carrier.
Submitting a claim within the claim period does not automatically mean that the claim will be approved.
Issues That May Qualify for a Claim
A claim may be considered when:
• New York Cosmetics shipped the wrong product, SKU, shade, size, or quantity
• Merchandise listed on the invoice was missing from the shipment
• The quantity received does not match the invoiced quantity
• A product arrived materially damaged or defective
• A sealed product arrived open, leaking, broken, or visibly contaminated
• The merchandise received materially differs from the product description
• The shipment sustained qualifying damage while in transit
• Another issue occurred that was directly caused by a verified fulfillment error by New York Cosmetics
Normal packaging wear, disclosed product conditions, disclosed expiration dates, manufacturer packaging variations, and ordinary characteristics of closeout merchandise do not qualify as fulfillment errors.
Information Required for a Claim
To request a review, the customer must provide:
• The order or invoice number
• The customer’s name and business name
• The delivery date
• The affected product name
• The SKU, UPC, shade, size, lot code, or batch code when available
• The quantity affected
• A clear description of the issue
• Photographs of the full product
• Close-up photographs showing the damage, defect, or error
• Photographs of the shipping carton and internal packing materials
• Photographs of the shipping label
• Photographs of the pallet before it was unpacked, when applicable
• A copy of the delivery receipt or bill of lading showing any damage notation
• Any other information reasonably requested during the investigation
The customer must keep the merchandise and all original packaging until New York Cosmetics confirms that the claim is resolved.
Products should not be discarded, used, resold, altered, repaired, relabeled, or returned while a claim is under review.
New York Cosmetics may require the customer to have the product in hand and provide the UPC, lot number, batch code, serial number, model number, or other identifying information to verify authenticity and eligibility.
Damaged Shipments and Carrier Claims
When New York Cosmetics arranges the shipment, we will coordinate the carrier claim for qualifying transit damage. The customer must cooperate with the investigation and provide all requested photographs, records, packaging, delivery documents, and merchandise.
The customer must:
• Note visible damage on the delivery receipt
• Take photographs before unpacking the shipment
• Preserve all damaged merchandise and packaging
• Make the shipment available for carrier inspection when requested
• Avoid discarding or altering the merchandise before the claim is resolved
• Provide all requested documentation promptly
Failure to preserve the merchandise or packaging, document visible damage, or cooperate with the carrier investigation may result in denial of the claim.
When the customer selects, hires, or directly arranges their own carrier, freight forwarder, pickup service, courier, or representative, the customer is generally responsible for pursuing any transit-damage claim with that provider. New York Cosmetics remains responsible for verified packing or fulfillment errors caused by New York Cosmetics.
Nonreturnable Merchandise
Unless New York Cosmetics provides written authorization as part of an approved claim, we do not accept returns of:
• Opened, tested, sampled, or used merchandise
• Merchandise with a broken, removed, or altered protective seal
• Cosmetics, skincare, personal care, hygiene, or intimate wellness merchandise
• Products that have been relabeled, repriced, stickered, marked, defaced, or altered
• Incomplete products or products missing components
• Products without their original packaging
• Products damaged after delivery
• Products damaged because of improper storage, heat, cold, moisture, handling, or transportation after delivery
• Merchandise with a different UPC, lot number, batch code, serial number, or model number from the merchandise originally shipped
• Merchandise with completed or altered warranty cards
• Products with expiration dates that were disclosed before purchase
• Custom orders, special orders, special configurations, or specially sourced merchandise
• Curated or customized reseller boxes
• Merchandise returned without a valid Return Authorization number
Hygiene-sensitive products cannot be returned merely because the customer no longer wants the item. They may only be considered when an approved claim establishes that the merchandise arrived damaged, defective, contaminated, incorrect, or improperly open upon delivery.
Return Authorization Required
No merchandise may be returned without written approval and a valid Return Authorization number issued by New York Cosmetics.
A Return Authorization number does not guarantee that a refund, replacement, or credit will be issued. All returned merchandise remains subject to inspection and final approval.
Unauthorized returns may be:
• Refused at delivery
• Returned to the customer at the customer’s expense
• Held until the customer pays applicable shipping charges
• Deemed ineligible for a refund, credit, or replacement
Do not send merchandise back until New York Cosmetics provides written return instructions.
Approved returns must be shipped within the deadline stated in the Return Authorization. Merchandise must be packaged securely and returned in the same condition in which it was received.
Resolution of Approved Claims
After reviewing an eligible claim, New York Cosmetics may, at its discretion and subject to applicable law:
• Replace the affected merchandise
• Ship the correct or missing merchandise
• Issue a credit for the affected merchandise
• Issue a partial refund for the affected merchandise
• Issue a refund to the original payment method
• Provide another commercially reasonable resolution
The available resolution may depend on product availability, the nature of the issue, carrier approval, the condition of the merchandise, and the documentation provided.
Replacement merchandise is subject to availability. If the same product is unavailable, New York Cosmetics may issue a credit, refund, or alternative resolution for the approved affected amount.
Claims are limited to the merchandise directly affected by the verified issue. An issue affecting part of an order does not ordinarily make the entire order eligible for return.
Return Shipping Charges
When a return is required because of a verified error by New York Cosmetics, New York Cosmetics will provide return instructions and determine the approved return-shipping method.
Customers should not independently purchase return shipping unless instructed to do so in writing. Unapproved expedited shipping, insurance, packing, handling, or accessorial charges may not be reimbursed.
When a return is accepted as a discretionary exception and is not the result of an error by New York Cosmetics:
• The customer is responsible for all return-shipping charges
• Original shipping and freight charges are nonrefundable
• The customer is responsible for ensuring the package arrives safely
• A restocking fee of up to 15% may apply
• Any carrier, handling, inspection, or processing charges may be deducted from the approved amount
If a shipment is returned because the customer provided an incorrect or incomplete address, refused delivery, failed to schedule delivery, failed to receive the shipment, or failed to pay carrier charges, the customer is responsible for all original shipping, return shipping, storage, redelivery, and reshipping costs.
Refund and Credit Processing
Approved refunds or credits are generally processed within 7 to 10 business days after the returned merchandise is received and inspected or after the claim is otherwise approved.
Refunds are ordinarily issued to the original payment method. The time required for a credit to appear depends on the customer’s bank, card issuer, payment provider, and billing cycle.
Original shipping, freight, handling, liftgate, appointment, residential delivery, storage, redelivery, and other carrier charges are nonrefundable unless New York Cosmetics determines that the charge resulted directly from its error or applicable law requires otherwise.
Manufacturer Warranties
New York Cosmetics does not provide a separate product warranty unless one is expressly stated in writing.
Any manufacturer warranty included with a product is provided by the manufacturer and is subject to the manufacturer’s terms, exclusions, registration requirements, and procedures.
New York Cosmetics does not guarantee that a manufacturer will honor a warranty on closeout, discontinued, liquidation, or secondary-market merchandise.
